Real Estate Photography Terms of Use
By commissioning photography services from Jared Powell Photography, the client agrees to the following terms:
1. Usage Rights The client is granted a non-exclusive, non-transferable license to use the delivered images solely for marketing the property photographed. This includes MLS listings, social media, flyers, and real estate websites directly related to the sale or rental of the property.
2. Ownership All images remain the intellectual property of Jared Powell Photography and are protected by U.S. copyright laws. No ownership is transferred through the purchase of photography services.
3. Third-Party Usage Images may not be sold, transferred, or distributed to third parties (e.g., builders, stagers, designers, other agents, or sellers) without written permission and may require a separate licensing agreement.
4. Alterations Images may not be edited, altered, or manipulated beyond cropping and resizing without prior written consent. This includes the application of filters or changes that may misrepresent the property.
5. License Duration The client is granted an unlimited-duration license to use the images for marketing purposes related to the property photographed. There is no expiration date on this usage license.
6. Attribution When posting on social media or digital platforms, Jared Powell Photography appreciates being credited for the photography when possible.
7. Cancellation & Rescheduling A minimum of 24 hours notice is required for cancellations or reschedules. Cancellations within 24 hours may be subject to a fee of $35
8. Photo Delivery Edited photos will be delivered within 1–2 business days from the date of the shoot, unless otherwise specified. Delivery times may vary for additional services such as video, floor plans, and drone.
9. Home Preparation The property must be clean, staged, and photo-ready at the scheduled time of the shoot. If the home is not prepared and the session cannot proceed as planned, a cancellation or rescheduling fee may apply at the photographer’s discretion. The photographer is not responsible for removing items or moving furniture.
10. Image Storage & Hosting It is the client’s responsibility to download and securely store all delivered photographs and media. The online listing site will remain active for 1 year from the date of activation. Renewal options are available upon request.
